Anyone here with labor law knowledge
 

I realize this is Wayyyy off topic, but seen other similar posts, so what the heck.

Not sure if that applies here, but closest to what information I am looking for, Here's the story.

Two weeks after applying for a job at a place, where i work through a temp service, I got an interview for Sunday March the 20th. Not sure why they do this on weekends, they just do. anyways i was told the following Thursday, they would look over all applicants and decide, who to hire. I recieved their little card that means "thanks but no thanks" on Friday after the deciding day, the next day after the deciding day. What bugs me is, this is the second time i had an interview (first in 2009) and asked then why i was passed over. I was told they couldn't discuss it, Why is that? They don't want to hurt feelings? confidential? I'll grant i am a big guy (over 300#) and may not be one of the fastest guys on the floor( this is a warehouse job, Loading and unloading trucks), but i have nearly three years through the temp service. Shouldn't that count over someone just walking in? Sorry for the rant, the bad typing and the long post, but i have a question.

Does a perspective Job have to tell you why they did not hire you if you ask? I would think, i'd be better prepared next time, if i knew what blew it for me. Links if found would be helpful in my quest, Thank you

Your weight could be an underlying factor as to why they didn't hire you. I understand where you are coming from, Im a big guy as well (320lbs).
It also could have been that you dont have forklift experience(do you?), Im assuming they have forklifts/Clamp trucks? It could have been a number of factors, or something as simple as they found someone that was better suited to the job.

I won't give a weight but i got you beat, maybe right on that note. As far as the forklift experience, most hired never set foot on a lift of any type before getting hired. I am just trying to find out if i can request a reason and they have to answer it. You see, this is an import warehouse for a large retailer chain, If the reason is fair, ok, i'll move on. But, if they are discriminating against me, i will take it to the next level. One thing i forgot to mention, being a temp is sort of a stigma, if you know what i mean. I just want to know, If it's a good reason, ok, I just want to know one way or the other

The problem with the weight, i am faster and better than most of their regular employees

From a fellow cookie lover I'm sorry to hear this, sounds like it could be another form of discrimination to me ? I dont think they have to tell you anything, your file is their business only.

That's what i was told the first time, hoping i can find something to contradict that. I have searched and found nothing, hoping someone here might know or stumble onto something

Nope. Even if they did they'd give a b.s. excuse about better qualified applicants or something.

Your time is better spent looking for employment than wasting energy on this.

Unfortunately, they may not be required to give a reason. It never hurts to ask, meet with your HR rep and explain to them why you want to know why you were looked over for the job. If they see you legitimately want to try and improve and advance within the company they might be more inclined to tell you. If you take a proactive role in bettering yourself and improving I can gaurantee you they will take notice.

Here in washington state a company can fire you and not even have a reason. A few people I know have been fired and they never did find out because the employer does not have to have a reason. Kinda sounds similar to what you are going through. Check and see if Georgia is a "right to work" state. Washington is not a right to work state and that is why they dont have to tell you. Sometimes I am glad i am self employed!

Every state has its own laws regarding hiring and firing of employees within its boarders. In most cases if you do not get hired it is because they hired someone who meets their needs better than you do. The only way time on the job counts is if you are actually one of their direct hire employees. Being a temp leaves you no options of recourse. It may be because they do not like your weight, your smell, your overall appearance, or just your face, or maybe your just a lousy worker. Maybe you have one eye that looks funny to them. Complaining about it will only put a target on your back and they will surely never hire you after that. You can surely ask them for an explanation, but by law in most cases they do not have to tell you jack. This is to protect your feelings as well as keep them from being shot in the face with a 44 Mag for insulting someone by telling them of their shortcomings.

Now if it were me doing the hiring, and you came back in to ask me what you can do in order to make yourself a better candidate for the next open position it is hard for them to wheezle out of answering that one. Then in the midst of them answering that question for you make sure you let them know that you really want to work for their company as a direct hire. That shows initiative and moxy which most employers like in their employees.

On the other hand if you are slow, or lazy, and always drop stuff or break equipment then I would not hire you either. I am only trying to make a few points of interest regarding your frustration. Maybe you are a substandard worker compared to others. We do not know you so we can not make judegments on your bahalf or advise you on ways to improve yourself without knowing you on the job.

Bottom line from my point of view is be the best you can be at whatever you do. Try your utmost, be on time, never run over on your breaks, dress the part for your job, take overtime when it is offered, continue your education on your spare time in whatever line of work you hope to achieve. If this is not the overall view you present, then any employer will overlook your application every time. Every employer wants the hardest workers on their team. That is how they beat out their compitition every time up to the plate. I hope this helps your inquizitive mind.

I dont think asking them will get you anywhere either. They have to be very careful what they say to you so most of the time they probably wont say anything. If there was something they didnt like, you would have an impossible time getting it out of them because then what they say might be seen as discrimenatory. They might have had a friend of a friend apply? Right now if you dont have a job a lot of places wont consider you for one which is highly discrimenatory, but they wont ever tell you that. My brother has a felony and no one will consider him, but they also wont tell him the reason, even though he has found out later through his friends that spoke with the boss.

Thanks for the input Jerry, I wasn't looking at time as though it were a union. This is Georgia, there is few if any unions down here. I was looking at it as experience, over the possibilities without experience.

Missing the point
 

I think you misunderstood. You could be on that temp job working at the same company for ten years, and put in for an opening for a full time direct hire position. If a guy coming in off the street shows up for the same job and impresses the supervisor with an outstanding resume', or maybe he is the bosses grandson. He may very well get hired over you and your time on the job there means absolutely nothing, because of your temp status. It is about performance not time on the job. In fact time on the job without a promotion shows the boss that you will keep working for less and continue to stay there no matter what they make you do. This is the one area in which a lot of people make the mistake of thinking that because they have been working on the job for many years that this gives them the upper hand, and can slack off some days.

There is no loyalty with employers these days. That era is long gone. If you are not the number one performer on your team or challenging him every day, then you are expendable short and sweet. The only way to keep your job is to out perform everyone else and do it consistantly. If not then you are settling for second best yourself. The best way to show your boss that you care about your job is to take good care of yourself. If you do not care about you, then why should your boss care about you. These are basic principles in management. He will only promote you as far as you are willing to go for him. Lead, follow, or get out of the way. Knowledge is power, and education is the key to success.

Not sure how it is there on the State side. Given your situation, in Canada; not much you can do. Even if you were hired, you could be rid of in a year. All the company has to do is pay your severance and add, "Sorry, it's nothing you did wrong. But, you do not fit this position. Here is 2 weeks pay and extended benefits. Bye."

Yea and even if you are the number one guy on your companies team you still stand a chance of being let go. Company going out of business, bankrupt, or hostile take over. There are no garauntees with any private companies any more. Its a cut throat world and there are no rainbows in any jobs these days. If your lucky you get to work in some kind of job that gives you pride and makes you happy to be a part of what you do, and those jobs are few and far between. If your doing what you like than consider yourself lucky and do it well. If not then move on and find something you can enjoy. I hear too many people complaining about how hard their job is. ITS WORK its supposed to be hard. If you put yourself into a blue collar trade, then live with it. That is why it is called LABOR. If you work in a white collar job and your stressed out all the time, then that is the trade off you get for not working in labor. If your not happy with what you are doing, then change it. Quit your job and go somewhere that makes you feel good about yourself. Life is just too dammed short to spend it working and complaining day after day, year after year about YOUR choices. We live in the home of the brave and the land of the free. Live your life the way you want. Good luck with that.
