Best thing you can do in this case is just communicate. Hopefully it doesn't turn into a he said she said thing. Do ensure him that he had used it now and that his use may have altered the motor as well. If he is half a decent person you two should be able to come to some better conclusion.
Some times things happen. I bought a 22oo off someone here and it was pretty much done. Bought it for 80, and the rear end cap was barely holding on. he front endcap had stripped mounting holes. I called him on it and he offered a partial refund because he refused a refund. I never saw the partial. I ended up sending it in to Castle for a non-warranty exchange. 160 for a motor. Kind of sucked.
