Japan solved all this in their RC community decades ago.

What they did was form a consortium of manufacturers and retailers. You were either in the consortium or couldn't buy or sell to any of it's members.

There was some pretty easy review process where someone who had done the engineering on something could file with the consortium and they would very quickly resolve the copy issue and force the offender to stop or be on the out.

From what I understand, it worked very well and still does today.
