This was his explanation: "i posted that it was brand new before i got the body then i got it and used it but forgot to change it to used. Im sorry about it and i didnt do it on purpose."

To me that seems like BS, but I'm not sure.

If he won't refund than I would leave negative feedback. Its one thing to have a miscommunication, oversight, or shipping issues, but if the seller won't make things right then you should warn others.

How long was it up for sale???? He's trying to tell you that in that short time period he bought it and got it all beat up but decided to sell it anyways like nothing happened.
